Matrimonial & Family

Divorce, maintenance, custody and matrimonial property, and proceedings under the domestic violence legislation.

What we do

Typical matters

  • Divorce, judicial separation and restitution
  • Maintenance under statute and under Section 125 CrPC
  • Custody, guardianship and visitation
  • Proceedings under the Domestic Violence Act
  • Return of stridhan and matrimonial property
  • Quashing and defence of related criminal complaints

Matrimonial matters are conducted in the family courts and, on appeal, before the Delhi High Court. The firm acts in petitions for divorce and judicial separation, in maintenance and custody proceedings, and in applications under the Protection of Women from Domestic Violence Act, 2005.

Where a settlement is possible, we say so and pursue it, because a mediated settlement usually gives a family a better result than a contested decree several years later.

Principal statutes

  • Hindu Marriage Act, 1955
  • Protection of Women from Domestic Violence Act, 2005
  • Guardians and Wards Act, 1890
  • Family Courts Act, 1984
